Aquaduct Data Strategies LLC (“Company,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects our users to do the same. This policy applies to all products and services operated by Aquaduct Data Strategies LLC, including:

Runner’s Review — Race discovery and review platform
Aquaduct Cascade — Data services platform
Biased Bites — Local dining discovery platform

In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond expeditiously to claims of copyright infringement committed using our services.

Filing a DMCA Takedown Notice

If you believe that content available on or through our services infringes your copyright, you may submit a written notification containing the following information:

Physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list.
Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material. Please provide specific URLs or other identifying information.

Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification containing:

Your physical or electronic signature.
Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the District of South Carolina if you are outside the United States), and that you will accept service of process from the person who provided the original notification or an agent of such person.

Counter-Notification Process

Upon receipt of a valid counter-notification, we will:

Promptly provide the complainant with a copy of the counter-notification
Inform the complainant that we will replace the removed material or cease disabling access to it within 10 business days
Replace the removed material or restore access within 10 to 14 business days after receiving the counter-notification, unless we receive notice that the complainant has filed a court action

Repeat Infringer Policy

We maintain a policy of terminating accounts of users who are repeat infringers.

Second infringement	Content removed; written warning issued; account restricted for 7 days
Third infringement	Account permanently terminated

What Counts as a Strike

A strike is recorded when:

We receive a valid DMCA takedown notice regarding content you posted
You do not file a counter-notification, OR
Your counter-notification is determined to be invalid, OR
The complainant files a court action following your counter-notification

Strike Removal

Strikes remain on your account permanently. Strikes are NOT removed by:

Filing a counter-notification (unless the original notice is withdrawn)
Passage of time
Appealing to customer support

Account Termination

Upon third strike:

Your account will be permanently terminated
You will be prohibited from creating new accounts
Content you posted will be removed
We may retain records of your infringement history for compliance purposes

Response Timeline

Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees.

Before filing a DMCA notice or counter-notification, consider whether the use of the material may constitute fair use.

Limitations

Modifications

We reserve the right to modify this policy at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes your acceptance of the modified policy.
